For the purposes of the Data Protection Act, Chapter 22:04 of Trinidad and Tobago, the data controller is Justin Phelps SC, of 20 New Street, Port of Spain. Questions about this Notice may be addressed to the clerk at clerk@caribbean.law.

When you submit an enquiry through the contact form on this website, we collect the information you provide: your name, your work email address, your telephone number, the name of your firm or organisation where relevant, the nature of the matter and your brief summary.

When you instruct the chambers as counsel, we additionally collect information necessary to act on your matter and to discharge our regulatory obligations, including identification documents under anti-money-laundering requirements.

When you visit this website, our hosting provider records limited technical information about the request (IP address, user agent, page requested, timestamp) for the purpose of operating the site and protecting it from abuse.

• To act on your instruction in accordance with the terms of engagement.
• To comply with our regulatory and statutory obligations, including anti-money-laundering, court rules and tax legislation.

We rely on legitimate interest for our use of enquiry information, on contract performance for instructed matters, and on legal obligation for retention of records required by regulators and the courts. Where consent is the applicable basis, we will tell you so at the point of collection.

Information you provide is accessed only by Justin Phelps SC, the clerk and any other person engaged on a confidential basis to assist with the matter. We do not sell personal information to third parties and we do not share it for marketing purposes.

We may disclose information where required to do so by law, by a competent court, by a regulator with jurisdiction over the chambers, or with your express consent.

Enquiry messages that do not result in an instruction are retained for up to 24 months from receipt and then deleted. Records relating to instructed matters are retained in accordance with the Legal Profession Act, the Limitation of Certain Actions Act, and any applicable record-keeping obligations under anti-money-laundering legislation, which may require retention of seven years or longer from the conclusion of the matter.

Subject to the limits set out in the Data Protection Act, you have the right to ask the chambers for a copy of the personal information we hold about you, to correct any information that is inaccurate, to ask that we delete information that is no longer needed, and to object to particular uses of your information.

Requests should be made in writing to clerk@caribbean.law. We will acknowledge a request within seven working days and respond substantively within thirty days, save where the request is complex.

We take appropriate organisational and technical measures to protect personal information against loss, misuse, unauthorised access or disclosure. Communications passing through this website are encrypted in transit.

If you believe we have not handled your information in accordance with this Notice or with the law, please contact us in the first instance. You also have the right to lodge a complaint with the Information Commissioner of Trinidad and Tobago.
