Areas of Practice
Justin Phelps SC maintains a commercial practice covering advocacy and advisory work across a broad range of commercial areas. Specialties include arbitration, commercial fraud, insolvency and company law. The three principal sub-practices are set out below; further capability extends across banking, construction (FIDIC), insolvency and competition matters, including work for governmental organizations.
Commercial Litigation
Advocacy in the superior courts of Trinidad and Tobago for shareholder disputes, breach of contract claims, banking matters, commercial fraud, and high-value corporate proceedings. Instructed by financial institutions, listed companies, statutory bodies and high-net-worth individuals.
Arbitration
Counsel in ICC and ad hoc commercial arbitrations. Particular focus on construction and engineering disputes under FIDIC forms, joint venture and shareholder arbitrations, and energy-sector contractual matters across the wider Caribbean.
Defamation and Media Law
Acting for both claimants and major media defendants in libel, slander and Caribbean social-media defamation. Recent work includes a leading 2023 first-instance damages award and a successful defence for the Trinidad Express in 2024.
